Terms & Conditions

These terms apply to all services and programs offered by Dr. Stephanie Dean Design & Research LLC, doing business as TouchstoneOS™ ("I," "me," "TouchstoneOS"). By booking a session, submitting payment, joining the Touchstone Studio, registering for a class or bootcamp, or signing a project contract, you agree to the terms below.

Parts 1 through 6 apply to everyone. Part A covers done-for-you projects and strategy sessions. Part B covers the Touchstone Studio membership. Part C covers classes, bootcamps and VIP upgrades. Where a signed project agreement differs from these terms, the signed agreement controls.


General terms (all services)

1. Communication & Boundaries

I respond to messages Monday through Friday during standard business hours (Central Time). Please allow up to 48 hours for thoughtful replies outside of scheduled calls. For longer engagements, we will use a shared workspace or document to track progress and next steps.

2. Confidentiality & Brand Trust

All strategy sessions and client materials are treated as confidential. I will never share your brand, strategy or content, verbally or in writing, without your explicit permission. You are welcome to request an NDA if needed.

3. Intellectual Property

My frameworks, methodologies, courses, recordings, templates and training content remain my intellectual property.

  • Your materials stay yours. Client-provided content, branding materials, contact lists and business information remain your property.

  • My materials are for your own business. Materials shared in sessions, the Studio or any class are licensed for use in your own business only. Please do not resell, redistribute, publicly post or replicate my original frameworks, slides, recordings or documents without written permission.

  • Done-for-you work: upon final payment, custom website design, content and development work become your property as outlined in the project agreement. I retain rights to general methodologies, frameworks, design approaches and code libraries for use with other clients.

4. Educational Tools, Templates & Resources

All educational materials, including Studio courses, live classes, recordings, brand voice quizzes, caption libraries, email and content templates, automations, social media guides, checklists and worksheets, are provided for informational and organizational purposes only.

They do not constitute legal, financial, compliance or other professional advice. They are designed to help you work more efficiently, not to replace professional consultation.

Your responsibilities:

  • Verify that all content, captions, emails, texts or materials align with applicable laws, industry regulations and your organization's policies before use.

  • Customize templates to fit your situation. They are starting points, not final content ready for publication.

  • Obtain any required approvals from your broker, compliance officer, licensing board, legal counsel or other relevant authority before publishing or implementing any materials.

Compliance-focused resources (including the Alabama Real Estate Agent Caption Library) reflect publicly available regulations and best practices as of the date stated in the resource. Regulations change frequently and vary by jurisdiction. I am not a lawyer, compliance officer or regulatory authority, and I do not guarantee compliance with any regulatory body, including but not limited to the Alabama Real Estate Commission (AREC), National Association of Realtors (NAR), the Fair Housing Act, the FTC, the TCPA, HIPAA, or industry-specific advertising rules. You remain solely responsible for compliance with current laws.

Indemnification: by using educational tools, templates or the TouchstoneOS platform, you agree to indemnify and hold harmless Dr. Stephanie Dean Design & Research LLC and TouchstoneOS™ from any claims, damages or liabilities arising from your use, modification or publication of materials or messages.

5. Limitation of Liability & No Guarantee of Results

Services, programs and the platform are provided "as is." I make no warranties or guarantees regarding income, leads, sales or other results. My total liability is limited to the amount you paid for the specific service in question (for the Studio, the fees paid in the three months before the claim). I am not liable for indirect, incidental, consequential or punitive damages, including lost profits or business opportunities.

6. Other Terms

  • Force majeure: I am not responsible for delays or inability to perform due to circumstances beyond my control, including natural disasters, government actions, internet or platform outages, or other unforeseeable events.

  • Right to decline or end work: I reserve the right to decline or discontinue work or membership if scope changes significantly, communication breaks down, community guidelines are not followed, or values become misaligned. Outstanding billable work will be invoiced accordingly.

  • Dispute resolution: these terms are governed by the laws of the State of Alabama. Disputes will first be addressed through good-faith negotiation. If resolution cannot be reached, disputes will be resolved through binding arbitration in Birmingham, Alabama.

  • Changes to these terms: these terms may be updated periodically. Clients and members will be notified of significant changes, and continued use of services constitutes acceptance of revised terms.


Part A: Done-for-you projects & strategy sessions

A1. Engagement & Payment

I offer both hourly and flat-rate pricing depending on the scope of work.

  • Strategy sessions are billed hourly unless otherwise agreed.

  • For larger projects (including website design and development), a 50% deposit is required upfront to reserve your spot, with the remaining 50% due upon completion.

  • Invoices are due within 30 days of receipt unless otherwise arranged in writing. Late payments may incur a 1.5% monthly service charge.

A2. Rescheduling & Cancellations

I ask for at least 24 hours' notice to cancel or reschedule a one-on-one session. Missed sessions or cancellations within 24 hours will be charged in full. My time is reserved for you, and I appreciate you respecting it. (Studio live classes and office hours are group sessions and are not covered by this section.)

A3. Scope of Work

Strategy sessions include: creative brainstorming, brand positioning, content and visibility planning, and directional support for marketing, storytelling or growth. Sessions may include a written summary or key takeaways. Additional revisions, feedback rounds or follow-up support may be scoped separately.

Website and digital projects include: platform migration and setup, custom design and development, content strategy implementation, technical integrations, and training and support as specified in the project agreement.

Not included: implementation beyond the specified scope unless agreed in advance.

A4. Timeline & Deliverables

Delivery timelines are estimates and may be affected by feedback cycles or unforeseen circumstances. You have 5 business days to review deliverables and request revisions. No response within that time constitutes acceptance and allows the project to proceed to the next phase.

Revision limits, unless your project agreement says otherwise:

  • Strategy sessions: up to 2 rounds on written deliverables

  • Video projects: up to 3 rounds

  • Website and digital projects: up to 3 major revision cycles during design and 2 rounds during development

Major scope changes mid-project may require additional time and cost.

A5. Prepaid Hours, Pauses & Reactivation

  • Prepaid sessions or hour blocks must be used within 60 days of purchase unless otherwise agreed. Unused hours do not roll over.

  • If a project is paused for more than 14 days without communication, a reactivation fee of 10% of the remaining project balance may apply to reschedule and restart work.

A6. Technical Specifications

Video deliverables are provided in MP4 format unless otherwise specified. Website deliverables include source files, login credentials and documentation as specified in the project agreement. File formats are confirmed at kickoff. I am not responsible for technical issues on your end (playback, device compatibility, hosting after delivery) or third-party platform changes after project completion.


Part B: The Touchstone Studio membership

B1. What's Included

The Touchstone Studio is a monthly membership that includes access to the course library, one live deep-dive class per month, office hours twice a month, the member community, and a TouchstoneOS platform account (built on HighLevel) for your business, while your membership is active. The class schedule, library content and features may change over time as the Studio grows.

B2. Price & Billing

  • Membership is $197 per month, billed automatically to your card on file on the same date each month until you cancel.

  • Active-duty military, veterans, military spouses and educators receive $50 off each month. I may ask for reasonable verification of eligibility.

  • I will give you at least 30 days' notice by email before any price change takes effect for your membership.

  • If a payment fails, I will notify you and try again. If payment is not resolved within 7 days, access to the Studio and your platform account may be paused until it is.

B3. Cancellation & Refunds

  • You can cancel anytime from your account or by emailing [email protected].

  • Cancellation stops future charges. You keep access through the end of the billing period you have already paid for.

  • Monthly fees are non-refundable, and partial months are not prorated.

B4. Your Platform Account

  • Your contacts, content and data belong to you.

  • The platform is provided through HighLevel, a third-party service, and is subject to HighLevel's terms of service and acceptable use policy. I am not responsible for outages, feature changes or pricing changes made by HighLevel.

  • Usage fees: some features carry usage costs (for example text messages, phone calls, email sending and AI features). [Choose one: These costs are included up to __ per month / These are billed to you at cost based on your usage.]

  • Messaging compliance is your responsibility. You agree to send email and text messages only to people who have given you permission, to honor opt-outs, and to follow applicable laws, including CAN-SPAM, the TCPA and carrier text-messaging registration requirements. Accounts used for spam or unlawful messaging may be suspended without refund.

  • When you cancel: you will have [30] days after your final paid period to export your contacts and content. [If you would like to keep your setup, I can help you move it to your own HighLevel account; ask me about options.] After that, the account and its data may be deleted.

B5. Live Classes, Recordings & Community

  • Live classes and office hours may be recorded and added to the Studio library. If you prefer not to appear, keep your camera off and use the chat.

  • What members share in the community and on calls stays in the community. Please do not share other members' businesses, screenshots or stories outside the Studio.

  • Be kind, stay on topic, and do not use the community to pitch or solicit other members. I may remove anyone who does not follow these guidelines.

  • Your membership is for you and your business. Please do not share your login.


Part C: Classes, bootcamps & VIP upgrades

  • Free events: registering for a free class or bootcamp adds you to my email list for that event and related updates. You can unsubscribe at any time. Free replays are available for the period stated at the event.

  • VIP upgrades (such as the $77 Bootcamp VIP) are non-refundable once the event has started. When a VIP upgrade includes a credit toward the Touchstone Studio, the credit applies to your first month only, must be used within the stated window (for example, within 7 days of the bootcamp), and has no cash value.

  • Recordings and materials from paid events are licensed for your own business use under section 3.
